LOCK BOX CODES?! Does your SELLER/Bank Let YOU give it out?

I just learned something new... an AH moment for me.

I've been trying to get in contact with a Realtor for DAYS regarding a property he has listed. BUT first I need to get the LOCK BOX CODE from him to GET IN, as he HAD put the WRONG one in the MLS!!! This has been going on for FIVE DAYS.  I call his office and am told, daily, he is IN a meeting (this dude must be terribly important).

My clients are getting TICKED to say the least, so she calls his office (and does NOT say she is working with ME) and says she wants to see this particular property.  Mr. IMPORTANT calls her right back...BUT says he is very busy, and gives her the CODE to get into the REPO and look at it heself.

Okay, times are changing I know, but giving out LOCKBOX CODES, regardless if it's a REPO or not, to me, is just plain old WRONG on so many levels!!

Fellow Realtors, are you experiencing this?

*** The MLS BOARD President got back to me: NO, A REALTOR CANNOT GIVE OUT ANY CODE TO A CONSUMER.

You WON'T submit my BUYER'S OFFER Unless THEY USE YOUR LENDER? ~ Well, You can KISS my GRITS!

VENT AHEAD!

I've been showing a ton of property lately. And while showing property, I am seeing it more and more in the LISTING AGENTS' REMARKS: Submit offer with PRE-APPROVAL letter from XYZ BANK, with FICO SCORES included, or your offer will NOT be submitted. (This is NOT happening in my local MLS, but instead from an Out-of-Area MLS) who lists homes in our mountain area.

On a recent offer I submitted for my buyers (on a repo property), they ALREADY had a lender and a pre-approval letter, as I had them do that before we went previewing homes. I included that letter with their offer to the listing agent. Then, THAT agent, or his bank, kicked back our offer DEMANDING my buyers get PRE-APPROVED WITH BANK OF AMERICA/Glendale Branch, or my offer would not be considered.

Is it me, or does this STINK to high heaven??? How can a Listing Agent, OR a BANK, tell MY client they MUST use a particular business/bank? I'm not certain this is even legal. I have a call into both the CALIFORNIA ASSOCIATION OF REALTORS (C.A.R.) and the MLS Board where this is happening.

I'd like to hear your comments and opinions.

...I'll also let you know what the legal hot-line tells me once I speak with them.

*** UPDATE: I just spoke with an Attorney with C.A.R. who did say it is OKAY FOR THE AGENT TO PUT INTO REMARKS that a BUYER pre-qual or pre-approve with a "Certain" lender. HOWEVER, he/she MUST have an agreement with that LENDER, where as the bank has said they will not look at any offers unless buyers follows those requests/guidelines. 

However, the Attorney agreed with me that these types of 'REQUESTS" could begin to tick off buyers, thus eliminating some of the buyers buying pool.

I discussed with him my FEAR that some Realtors could be "working" too closely with some of these BANKS, in which he brought up RESPA.  GREAT POINT, I told him.

So for now, I guess these BONEHEAD BANKS can get away with this.  BUT I am thinking, they'll eventually start screwing up and this issue will one day (soon I am betting) make front page news!

One of the questions I get often from new clients is, "Can you fish around here?" I say, "Even through you can't fish in Lake Arrowhead Lake (unless you live IN Lake Arrowhead and have Lake Rights, there are MANY other local spots to toss in your line and hook up with some trout or bass. Below is a list to give you a good idea where you can go "Catch the Big One!"

LAKE GREGORY; 909-338-2233. Rent paddle, motor or row boats. Catch: Trout and Catfish

GREEN VALLEY LAKE; 909-867-2009. Rent paddle or row boats. Catch; Trout

SILVERWOOD LAKE;  760-389-2299. Rent Pontoon and Aluminum boats. Catch; Bass, Trout or Catfish

BIG BEAR LAKE; 909-866-5796. Rent a variety of boats. Catch; Bass, Trout and many other kinds.

DEEP CREEK; This is a WILD TROUT STREAM.

Things to remember:

  • CALIFORNIA FISHING LIC' required.
  • Limit, TWO fish
  • Minimum length, 8 inches or loner
  • What to use, ONLY artificial lures and flies with BARBLESS hooks
  • NO BAIT OF ANY KIND
  • YOU NEED an Adventure Pass to par your car in our National Forest.

How Valuable is YOUR time? Mine is as Valuable as YOURS, for sure!

This is a mini-vent you might say:  I "had" a new client who found me on my blog... That's SUPER! So he calls (ONCE at 11:00 PM!) a few times to give me his criteria and emails a few times to follow up before making an appointment with me to see homes.  AWESOME!

On the scheduled date, I showed up 10 minutes early, sip my Java that I've picked up, and I wait. And wait. And wait. 30 minutes is my MAX and so after that allotted time, I'm outta there. On to the rest of my day, I say. (NO, I didn't call this person). 

TWO days later I get an "email" saying he had to suddenly leave and go to Europe and would like to set up a time to come to preview property on May 30. You know when someone is lying, and I KNEW he was.

My response to his email? "You NEED to find another Realtor BECAUSE my TIME is as VALUABLE as YOURS. And... YOU'RE VERY RUDE!"  

 

Yeah, that's exactly what I wrote and exactly what I meant.  The older I get, the more important my time is to me. And I am not desperate enough for business to work with people who have NO RESPECT for other people and their time... Life really is short and I like filling it with folks who are worthy of my time.

Okay, vent over. HAVE A HAPPY DAY!

P.S. Yes, this is a public post. I want the public to know how much I "value" their time.

GARAGE SALE WEEKEND IN LAKE ARROWHEAD ~ Memorial Weekend May 23, 24, 25, 2009!!!

That time of year is fast appproaching...                                                May 23, 24, 25, 2009

  • MEMORIAL WEEKEND, a time we honor the men and women who've died during military service for our country. 
  • The first THREE DAY HOLIDAY since winter (actually opening up the season for "vacations" and fun in the sun).
  • IT'S ALSO"GARAGE SALE WEEKEND" in our local mountain towns.  Yippee!!!

Every Memorial and LABOR DAY Weekends, here in the Lake Arrowhead and our surrounding mountain towns, we have a Three-Day Garage Sale.  It's not only a great time to go through your garage or closets and get rid of stuff you no longer need or use, it's a perfect time for buyers who've just purchased a cabin/home to get it furnished by what I call, The Recycling System.

And, it's fun!! I'm planning to head out Sat. morning in hopes of finding some "slightly used" (LOL) patio furniture and a bar-b-cue. But chances are I'll come home with something I thought I "just couldn't live without."

BUYERS: Here's What I do For YOU, When you HIRE me ~ Plain and Simple

Buying a home, even if you'd been through the process many times or you're a First-Timer, can be daunting. Since this is the biggest investment you're likely to ever make, you need to know you are in the hands of a Professional (using a Realtor) who knows what they're doing. I can say with certainly, that I do. Let me walk you through the process....

I WILL EXPLAIN THE REAL ESTATE BASICS:

  • The "Agency" Relationship (when you hire me, these are my DUTIES to you)
  • From beginning to end, the Purchase Process
  • Explain the Purchase Contract

IF YOU'LL BE GETTING A LOAN:

  • We'll discuss "The Loan Process" and IF you're not working with a lender, I'll give you a list of names of professional lenders I'm familiar with.
  • You meet with the lender.
  • The lender will tell you a reasonable price range for your "home search"

SELECTING THE HOMES THAT FIT YOUR NEEDS:

  • With your budget in mind, we'll narrow down your "Wants, Needs & Wish List" 
  • I'll give you DETAILED Information on the homes you've chosen
  • We'll schedule a time to "Preview" the homes on your list

 NEGOTIATE THE PURCHASE:

  • Once you've found a home you can't live without, and you wish to make an offer, I'll check my local Multiple Listing Service (MLS) and show you the "comparables" (COMPS)  
  • I'll prepare the RESIDENTIAL PURCHASE AGREEMENT and explain the content before you SIGN
  • I'll contact the LISTING Agent and set up a time to Present YOUR Offer to her/him
  • Once an Agreement is reached (all parties agree to the contract), we will go to the next step...

OPENING ESCROW (in the state of CA, we use an unbiased third party (escrow)  to handle the money):

  • We will be given an Escrow # and the name of the escrow officer. 

 THE INSPECTIONS:

  • If you do not have, or know,  a Home Inspector, I will provide you with names of local inspectors.
  • Once you've selected your inspector, a date is set for the inspection.
  • I WILL be there, even if you're unable to attend, and it this time I will ALSO do my agent visual inspection (AVID)
  • Once the inspection is done, the inspector will prepare a report for you and provide you and me with a copy.
  • We'll decide which items, if any, you'd like to ask the sellers/s to repair.This doesn't mean the seller has to make any repairs, however. All they MUST do is have working smoke detectors and the water heater properly braced.
  • If there is a Termite Inspection to be done, one will be ordered by the party agreeing to pay for this inspection.

THE CLOSING:

  • Your lender will prepare the loan documents send them to the escrow officer and you will be instructed where to come and sign the necessary papers.
  • You'll BRING a check in the amount your escrow officer has instructed.
  • Once signed, the papers go back the lender, with the check to make certain all I's have been dotted and T's crossed. If all is correct...
  • The Deed to the home is taken to the county recorders office and is PUT INTO YOUR NAME
  • I get a call from the Escrow office that we have "Recorded"
  • YOU ARE NOW A HOME OWNER; I'll deliver the KEYS to you!

May 16, 2009 6:30PM: The Concert Series continues at CENTER STAGE in Lake Arrowhead Village. This is a special event because it'll be benefiting our  MOUNTAIN COMMUNITY HOSPITAL Foundation. This evening's performer is MICHAEL JOHN, a Billy Joel Tribute Band.

May 16, 17, come see THE NEW BOAT SHOW at Lake Arrowhead Village.

May 17th: ARROWHEAD ARTS ASSOCIATION will be featuring one of their classical concerts with  The Tilden Trio: Sarn Oliver, violin  Peter Wyrick, cello  June Choi Oh, piano.

LAKE ARROWHEAD LIBRARY. Our local library is special for young and old. For instance, they have programs for Preschoolers & Kindergartners called "Story time," which is based on the "Every Child Ready to Read" program. This program helps promote the six literacy skills every child needs before heading off to "real" school.
